Our Credit Reporting Policy contains information about how you may seek correction of credit information we hold about you, how you may complain about an alleged breach of our obligations in relation to your credit information, and whether we disclose your credit information to overseas entities.

3.2 Sensitive information includes personal information relating to racial or ethnic origin, criminal history, sexual orientation, political opinions, religious beliefs, membership of professional or trade associations, health information and biometric information.

4.4 We may use artificial intelligence and automated technologies in connection with our business operations, including communications, marketing, document preparation, data processing, customer service, compliance functions and administrative activities. Personal information provided to us may be processed using these systems for those purposes.
4.5 We take reasonable steps to ensure that any third-party technology, AI or compliance providers engaged by us are subject to appropriate privacy, confidentiality and security obligations.
4.6 In order to comply with applicable anti-money laundering and counter-terrorism financing legislation, we may collect and verify identification information and documents from clients, customers, buyers, sellers, landlords, tenants and other parties involved in transactions. This information may be disclosed to third-party identity verification and compliance providers for verification purposes.

5.2 The cloud storage services, technology platforms and IT servers used by us may be located outside Australia.
5.3 Prior to disclosing your personal information to an overseas recipient, we will take reasonable steps to ensure that:
(a) The overseas recipient does not breach the Australian Privacy Principles;
(b) The overseas recipient is subject to laws or binding schemes substantially similar to the Australian Privacy Principles; or
(c) You have consented to the disclosure.
Acceptance of our services by written, verbal or electronic means will be deemed consent to such disclosures.

6. Access and Correction

6.1 You may request access to the personal information we hold about you at any time.
6.2 We generally respond to requests within seven (7) days.
6.3 We may refuse access where permitted by law, including where access would pose a serious threat to health or safety, unreasonably impact another person’s privacy or where the request is frivolous or vexatious.
6.4 If you believe information we hold about you is inaccurate, incomplete, out of date or irrelevant, please contact us so we may correct it.

10. Interpretation

10.1 In this Policy unless the context otherwise requires:
(a) Words importing one gender include all genders;
(b) The singular includes the plural and vice versa;
(c) A person includes a corporation, trust, partnership and other legal entities;
(d) References to related entities include directors, officers, employees, contractors, agents, successors and assigns; and
(e) Headings are for convenience only and do not affect interpretation.
10.2 Business means any business operated by us as described in Item 2 of the Schedule.
10.3 Our, we or us means the entities described in Item 1 of the Schedule and their related entities.
10.4 Products and Services means any products or services supplied by us including those described in Item 3 of the Schedule.

11. Conjunction Sales

11.1 The Client acknowledges that we are not obligated to enter into a conjunction arrangement with another sales agent unless agreed by us in writing.
11.2 Where a conjunction arrangement has not been agreed:
(a) We are under no obligation to communicate or cooperate with the conjunction agent; and
(b) We will not be liable for any loss suffered arising from:
(i) our refusal to agree to a conjunction; or
(ii) any failure to communicate or cooperate with a conjunction agent.
11.3 Any conjunction arrangement is subject to our Conjunction Policy and Procedures.
11.4 The benefit of this clause may only be waived in writing.

12. Appointment of New Agent

12.1 If the client appoints another agent to perform services during the term of an existing appointment, the client may be liable for:
(a) Commission under each appointment; and
(b) Damages for breach of contract under the existing appointment.

13. Communication of Offers

13.1 Clark Real Estate is required to communicate all offers to buy the property where the potential buyer has signed a contract.
